DMCA Policy
BTD Journal ("we", "our", "us") respects the intellectual property rights of others and expects users of our website, btdjournal.com (the "Site"), to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), it is our policy to respond to any notice of alleged copyright infringement that complies with the DMCA and to take appropriate action.
1. Notification of Copyright Infringement
If you are a copyright owner or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Site, please submit a written notification of copyright infringement (a "DMCA Notice") to our designated DMCA Agent, including the following information:
-
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
-
Identification of the copyrighted work claimed to have been infringed, or, if multiple works, a representative list of such works.
-
Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the Site.
-
Your contact information, including address, telephone number, and email address.
-
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
-
A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
2. Counter-Notification
If you believe that your material that was removed or disabled is not infringing, or that you have authorization from the copyright owner or the law to post and use the content, you may send a written counter-notification to our DMCA Agent that includes the following:
-
Your physical or electronic signature.
-
Identification of the content that has been removed or disabled and its location before removal.
-
A statement under penalty of perjury that you have a good faith belief the content was removed or disabled as a result of mistake or misidentification.
-
Your name, address, telephone number, and email address.
-
A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., that you consent to jurisdiction in any district where BTD Journal may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
Upon receipt of a valid counter-notification, we may forward it to the original complaining party. If the original party does not file an action seeking a court order within 10 business days, we may, at our discretion, restore the removed content.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, BTD Journal has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit or terminate access to the Site for any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
